§ 1 General
The following terms and conditions apply to all digital goods ordered by the customer via www.koko-photography.com. Koko Photography does not recognize conflicting terms and conditions of customers unless their validity has been expressly agreed between the parties.

§ 2 Conclusion of contract

Offers of goods listed are subject to change without notice as long as they do not become the subject of a contractual agreement. Offers are only valid while stocks last. An online order by the customer constitutes a binding offer to Koko Photography to conclude a contractual agreement. By placing an order, the customer accepts these general terms and conditions. The General Terms and Conditions are available online for retrieval. They can be downloaded, printed or archived. When purchasing software or other digital data via download, the binding contract is concluded by sending the customer's order to Koko Photography.

 

§ 3Prices and shipping costs

For orders the prices listed in the offer at the time of the order apply. Prices quoted in the offer are gross prices. In the shop exclusively digital products are offered, whereby all forwarding expenses are void.

 

§ 4 Payment and Delivery

Ordered goods will be delivered as soon as possible after receipt of the order. The delivery usually takes place immediately after receipt of payment.
The payment takes place by Paypal and is due before the delivery of the commodity, at the latest 7 days after invoice entrance. Offsetting by the customer is only permissible if his claim is undisputed or has been legally established. The obligation to deliver does not apply if Koko Photography itself was not supplied or not supplied in time and is not responsible for the lack of availability.

 

§ 5 Revocation

According to law, digital products are not suitable for return due to their nature. There is therefore no right of withdrawal.

 

§ 6 Rights of use and copyrights

All copyrights remain exclusively with Koko Photography even after the conclusion of a contractual agreement. The distribution of Lightroom presets, or other digital products purchased, rental or reproduction is strictly prohibited.

 

§ 7 Data protection

As far as personal data are disclosed to Koko Photography within the framework of contractual relationships, he is entitled to store them for the purpose of contract processing and for further advertising measures on the part of Koko Photography. The customer expressly agrees to this. Koko Photography undertakes not to pass this data on to third parties without consent.

 

§ 8 Applicable law, partial invalidity, place of jurisdiction

German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If individual provisions of the delivery contract or of these General Terms and Conditions are invalid, the remaining clauses shall remain valid.

The place of performance and performance shall be Stuttgart, Germany, to the extent permitted by law. To the extent permitted by law, the place of jurisdiction for all disputes arising from contractual relations shall also be Stuttgart.
Koko Photography is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

The european commission provides a platform for online dispute resolution (OS) which is accessible at https://ec.europa.eu/consumers/odr. We are not obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.
